Since the 1940s Harold Garfinkel developed ethnomethodology as a distinctive sociological attitude. This sociological attitude turns the focus of the analysis of interaction to the actor’s perspective. It suggests that interaction is ongoingly produced through actions that are organized in a retrospective and prospective fashion. The ethnomethodological analysis of interaction therefore investigates how actors produce their actions in light of their analysis of immediately prior actions and in anticipation of possible next actions. Ethnomethodologists describe the relationship of actions emerging from (...) this analysis as “sequential”. This article discusses how Garfinkel’s description of practical action as “experiment in miniature” can be seen as a precursor to the concept of “sequentiality” that defines today’s ethnomethodological analysis of interaction. Having discussed the intellectual background to ethnomethodology the article briefly explores two fragments of interaction audio-/video-recorded in a museum and an optometric consultation to illustrate the key concerns of this kind of analysis. The article closes with a short reflection on current developments in ethnomethodology and their relationship to sociology. (shrink)

The topic of this essay is akrasia in its most paradoxical kind, as it appears to us in the emblem of Medea. The argument starts with the claim that the problem with akrasia is especially a problem of rational potentiality: to understand it philosophically, we are forced to embrace the idea that its possibility is immanent to the rational capacity of action. By discussing elements of Plato's, Aristotle's, and Davidson's explanations of practical irrationality, the argument proceeds to demonstrate that the (...) reasons a practical capacity provides exist as „forces,“ that rational forces are structurally in excess with respect to their normative statuses, and that Medea is the mythical figure par excellence of such an immanent excess of rational agency. On account of these insights, we can begin to understand that akrasia is not only a kind of failure, or incapacity, but entails the very possibility of a „metamorphosis“ of the subject. (shrink)

Dieser Aufsatz umreißt die Grundzüge eines neuen philosophischen Programms, das sich selbst in Fortentwicklung und Abgrenzung vom Methodischen Konstruktivismus als „Methodischer Kulturalismus“ begreift. Ausgehend von einer Kritik von Naturalismus und Kulturrelativismus erfolgt eine Darlegung der epistemologischen und handlungstheoretischen Grundlinien einer methodischen Begründung von Wissenschaft und Ethik auf der Basis der kultürlichen Lebenswelt.

In dem Aufsatz wird eine kulturalistische Relevanzlogik im Rahmen des Methodischen Kulturalismus zu entwickeln versucht. Hierfür werden sowohl die Probleme, die in den Logikbegründungsversuchen des Methodischen Konstruktivismus auftraten, besprochen, als auch Probleme der Klassischen und der Intuitionistischen Logik sowie der Minimal- und Relevanzlogik als solcher. Neben der Kulturalistischen Relevanzlogik im engeren Sinne werden durch zusätzliche Anforderungen an die Prämissenmengen weitere Logiken begründet – beschränkt man sich auf konsistente Prämissenmengen, erhält man die kulturalistische Variante der Intuitionistischen Relevanzlogik, beschränkt man sich auf (...) entscheidbare Diskursbereiche, erhält man eine Klassische Relevanzlogik und bei Beschränkung auf konsistente und entscheidbare Diskursbereiche eine Starke Klassische Relevanzlogik. Die erläuterungsbedürftige Aufforderung: eine kulturalistische Wende zu vollziehen, wird als Ausgangspunkt verwendet, um das philosophische Selbstverständnis des Methodischen Kulturalismus dazulegen. Dieser versteht die Wende als eine Abwendung vom Naturalismus, wie er in der Position Quines am radikalsten vertreten wird. Gegen die Annahme, die im Rahmen einer naturalisierten Erkenntnistheorie typischerweise formuliert wird, dass eine absolute Beobachterperspektive innerhalb der Naturwissenschaften eingenommen werden kann, wird geltend gemacht, dass die naturwissenschaftliche Praxis die normative Unterscheidung zwischen wahr und falsch voraussetzt, um gelingend betrieben werden zu (...) können. Die Abwendung vom Naturalismus führt aber nicht in den Kulturrelativismus, da mit dem Handlungserfolg ein außerdiskursives Element des Einlösens von Geltungsansprüchen zur Verfügung steht. Die Aufforderung zur kulturalistischen Wende beinhaltet zum einen eine Abwendung von Szientismus, ohne dabei auf die sprachkritischen Mittel des linguistic turn zu verzichten, und zum anderen eine Hinwendung zu Themengebieten, die der Methodische Konstruktivismus - die Vorgängerposition zum Methodischen Kulturalismus - bislang ausgeblendet hatte. Der methodische Kulturalismus bestimmt sich selbst durch eine Abkehr vom erkenntnistheoretischen Naturalismus, Realismus und Kulturrelativismus. Er sieht im Handlungserfolg ein diskursunabhängiges Kriterium für die Einlösung von Geltungsansprüchen in theoretischen Redekontexten. Der Aufsatz legt die kulturalistische Perspektive in Bezug auf die Praktische Philosophie dar. Hierbei wird aber verneint, dass es im Bereich der Praktischen Philosophie ein diskursunabhängiges Kriterium für das Einlösen von praktischen Geltungsansprüchen geben kann. Die Ergebnisse erheben damit keinen universellen Geltungsanspruch (und insoweit wird dem Kulturrelativismus Recht gegeben), aber sie (...) erheben in Bezug auf posttraditionale Gesellschaften einen partikularen. In diesen Gesellschaften hat sich (historisch kontingent) etabliert, dass Normen gegenüber den Mitgliedern der Gemeinschaft nicht durch den Verweis auf die Tradition oder eine Autorität begründet werden sollen. Wie sich eine normative Ethik unter dieser Prämisse begründen lässt, wird im ersten Teil des Artikels expliziert. Sie wird dort als eine Beratungsethik konzipiert, die das Ideal der gewaltfreien Konfliktbewältigung verwirklichen soll (welches aber als solches nicht universell gerechtfertigt werden kann). Obgleich die These vertreten wird, dass die eudaimonistische Ethik keine Grundlegung für die normative Ethik sein kann, wird zugestanden, dass sich für die praktische Philosophie noch weitere Fragen ergeben, wenn die normative Ethik abgeschlossen ist. Diese beziehen sich auf das Gute und geglückte Leben und lassen sich im Rahmen einer eudaimonistischen Ethik bearbeiten. Nach seiner Rückkehr aus dem US-amerikanischen Exil 1949 unternahm das Institut für Sozialforschung zahlreiche sozialempirische Studien über das politische Bewusstsein der westdeutschen Bevölkerung und dessen ideologische Grundlagen. Anknüpfend an die Erfahrungen, die das IfS mit der in den Vereinigten Staaten durchgeführten Untersuchung zur »Authoritarian Personality« gesammelt hatte, war das als Pilotstudie konzipierte »Gruppenexperiment« die erste und umfassendste der Untersuchungen über die ideologischen Haltungen der bundesrepublikanischen Bevölkerung, in diesem Fall gegenüber dem NS-Regime und der aktuellen Demokratie. Diese erste große sozialempirische »Bewusstseinsstudie« (...) wurde vom U. S. High Commissioner for Germany finanziert und bildete inhaltlich und methodologisch die Grundlage aller weiterer »Bewusstseinsstudien«, etwa zur Erforschung des Bewusstseins der Studenten, der Arbeiter, der zukünftigen Bundeswehroffiziere und eben der Kriegsheimkehrer. This article argues that corporate social responsibility may contribute to product differentiation in export markets and thus improve export performance. We test this argument by observing a period of decreasing export competitiveness in a leading emerging economy. Using a large-scale survey design with 252 questionnaires completed by mediumand large-sized Brazilian exporters, we used structural equations modelling to test our hypotheses. The results suggest that CSR product differentiation predicts export performance better than product quality differentiation and almost as well as product (...) innovation differentiation. Multi- group analysis further revealed that the positive and significant effect of CSR product differentiation on export performance is likely to be contingent on the number and type of countries that are targeted. Our study contributes to the literature on CSR and export performance by developing and empirically validating a model that explains under which conditions CSR-based product differentiation may lead to improved export performance. This paper reassesses the domain of the business ethics curriculum and, drawing on recent shifts in the business environment, maps out some suggestions for extending the core ground of the discipline. It starts by assessing the key elements of the dominant English-language business ethics textbooks and identifying the domain as reflected by those publications as 'where the law ends' and 'beyond the legal minimum'. Based on this, the paper identifies potential gaps and new areas for the discipline by drawing on (...) four main aspects. First, it argues that the domain of business ethics requires extensions dependent on the particular geographic region where the subject is taught. A second factor for broadening the scope is the impact of recent scandals, which arguably direct the focus of ethical inquiry towards the nature of the business systems in which individuals and corporations operate. Third, the impact of globalization and its result on growing corporate involvement in regulatory processes is discussed. Fourth and finally, business ethics reaches beyond the traditional constituencies of 'economic stakeholders' as new actors from civil society enter the stage of ethical decision making in business. We conclude by suggesting that a reconsideration of the domain of business ethics, especially in Europe, is timely, but that to do so represents a major challenge to business ethics educators. The domain of numbers provides a paradigmatic case for investigating interactions of culture, language, and cognition: Numerical competencies are considered a core domain of knowledge, and yet the development of specifically human abilities presupposes cultural and linguistic input by way of counting sequences. These sequences constitute systems with distinct structural properties, the cross-linguistic variability of which has implications for number representation and processing. Such representational effects are scrutinized for two types of verbal numeration systems—general and object-specific ones—that were in parallel (...) use in several Oceanic languages. The analysis indicates that the object-specific systems outperform the general systems with respect to counting and mental arithmetic, largely due to their regular and more compact representation. What these findings reveal on cognitive diversity, how the conjectures involved speak to more general issues in cognitive science, and how the approach taken here might help to bridge the gap between anthropology and other cognitive sciences is discussed in the conclusion. Via a historical reconstruction, this paper primarily demonstrates how the societal debate on genetically modified organisms (GMOs) gradually extended in terms of actors involved and concerns reflected. It is argued that the implementation of recombinant DNA technology out of the laboratory and into civil society entailed a “complex of concerns.” In this complex, distinctions between environmental, agricultural, socio-economic, and ethical issues proved to be blurred. This fueled the confusion between the wider debate on genetic modification and the risk assessment of (...) transgenic crops in the European Union. In this paper, the lasting skeptical and/or ambivalent attitude of Europeans towards agro-food biotechnology is interpreted as signaling an ongoing social request – and even a quest – for an evaluation of biotechnology with Sense and Sensibility. In this (re)quest, a broader-than-scientific dimension is sought for that allows addressing the GMO debate in a more “sensible” way, whilst making “sense” of the different stances taken in it. Here, the restyling of the European regulatory frame on transgenic agro-food products and of science communication models are discussed and taken to be indicative of the (re)quest to move from a merely scientific evaluation and risk-based policy towards a socially more robust evaluation that takes the “non-scientific” concerns at stake in the GMO debate seriously. ABSTRACTDot-probe studies usually find an attentional bias towards threatening stimuli only in anxious participants, but not in non-anxious participants. In the present study, we conducted two experiments to investigate whether attentional bias towards angry faces in unselected samples is moderated by the extent to which the current task requires social processing. In Experiment 1, participants performed a dot-probe task involving classification of either socially meaningful targets or meaningless targets. Targets were preceded by two photographic face cues, one angry and one (...) neutral. Angry face cues only produced significant cueing scores with socially meaningful targets, not with meaningless targets. Those are the overarching dynamics of Verene's book.There is an introduction, then two parts, "Prolegomena Philosophiae," comprising four chapters, and "Three Rhetorics," comprising three chapters, followed by an epilogue, notes, and an index.Though Verene does not mention Hume in the introduction—and only twice in the book otherwise—it is difficult not to think of him when Verene speaks of philosophy as "a theater of memory," as if correcting Hume's "theater of the mind." It is also corrective to presentism, often attributed to Hume, when Verene claims that a chief task of the philosopher "is to keep us from always living in the present. For this labor to be accomplished the philosopher must go to school with both the poets and the orators." Rhetoric, rightly understood, helps philosophy to remain philosophy and prevents it from becoming sophistry.In chapter 1, "Philosophical Thinking," Verene reminds the reader that mortality is not a choice. The bounded nature of human life leads to the pursuit of happiness and, therefore, also to the pursuit of meaning. The human responds in two ways, by creating both arguments and stories, but arguments as well as stories need words.The "and yet" comes in the second chapter, "Philosophy and the Muses." Verene writes, "The philosopher knows that the real always outstrips language." Philosophy and its kin, poetry, point beyond themselves. Writing is remembering, but what is written, even at its best, can never capture all that is remembered, and memory, even at its best, can never capture all that is.In "Philosophy and Eloquence," Verene maps a way of escaping Kant. Modern philosophy rejects rhetoric and memory in its pursuit of novelty as progress. Verene introduces the concept of ingenium, "a power philosophy shares with rhetoric." It "is the ability to perceive similarity in dissimilars.... the power to produce metaphor" and irony. "The ball is red" is generative of a ball that is not merely a ball but also something else, something foreign to its ballness. The ball gives up nothing of what it was but, rather, gains something that it was not, and yet not in the deterministic way of necessity. The ball does not have to be red, but if it is red, then "ball" and "red" constitute an inner dialectic. The ball is red predicatively and not tautologically, but separating out the kinds of predication does not exhaust all the mystery of the inner dialectic; nothing can.The three rhetorics are of "Self-Discourse," "Absolute Thought," and "The Philosophical Frontispiece." These are chapters respectively about speech appertaining to man, God, and the political entity, though each considered slant rather than head-on.Verene juxtaposes Descartes and Vico with respect to self-discourse. Descartes reframes the human being in terms of the first-person singular pronoun, thereby transforming the personal into the categorical. Vico responds by writing not an "autobiography" but, rather, The Life of Giambattista Vico Written by Himself, thereby transforming the pronoun for the other, "he," into the self-identifier. There follows an essay on the essay and especially on the essays of Montaigne as autobiography. We set out a fundamental ontology of atomism in terms of matter points. While being most parsimonious, this ontology is able to match both classical and quantum mechanics, and it remains a viable option for any future theory of cosmology that goes beyond current quantum physics. The matter points are structurally individuated: all there is to them are the spatial relations in which they stand; neither a commitment to intrinsic properties nor to an absolute space is required. To reduce the global burden of the COVID-19 pandemic, there is an urgent need to develop a safe vaccine. Vaccine development usually takes many years as it goes through several different phases. To hasten COVID-19 vaccine development, it has been suggested that the final stage could be replaced with a human challenge trial. Volunteers would be intentionally infected with SARS-CoV-2 to see how the vaccine candidate works. To intentionally infect a healthy human being with a potentially deadly virus is contrary (...) to the highest ethical standards in medical research. This article highlights the benefits and risks of COVID-19 HCTs and summarises what research ethics committees need to consider during the ethical assessment of such trials including risk reduction, strict containment measures, specific informed consent measures and avoiding high monetary inducements. In their recent paper on “Challenges in mathematical cognition”, Alcock and colleagues (Alcock et al. [2016]. Challenges in mathematical cognition: A collaboratively-derived research agenda. Journal of Numerical Cognition, 2, 20-41) defined a research agenda through 26 specific research questions. An important dimension of mathematical cognition almost completely absent from their discussion is the cultural constitution of mathematical cognition. Spanning work from a broad range of disciplines – including anthropology, archaeology, cognitive science, history of science, linguistics, philosophy, and psychology – we (...) argue that for any research agenda on mathematical cognition the cultural dimension is indispensable, and we propose a set of exemplary research questions related to it. When making an assessment of animal welfare, it is important to take environmental (housing) or animal-based parameters into account. An alternative approach is to focus on the behavior and appearance of the animal, without making actual measurements or quantifying this. None of these tell the whole story. In this paper, we suggest that it is possible to find common ground between these (seemingly) diametrically opposed positions and argue that this may be the way to deal with the complexity of animal (...) welfare. The model will have to be acceptable for the different parties that will be affected by it and real benefits for the animal should result from it. This will be the basis of a practical ethical approach. All this can be condensed into a model that essentially is made up out of three basic elements: the classical welfare analysis with an existing welfare assessment tool, an assessment of the stockholder, and an implementation of the Free Choice Profiling technique. This new framework does not pretend to be a different or better animal welfare matrix; it is intended to integrate existing knowledge and to provide a practical tool to improve animal welfare. It identifies whether there are welfare problems on a farm, if present whether these problems are caused by the housing system or the stockholder, and what can be done to improve the situation. Ein Ziel der Neuregelungen der Insolvenzordnung war es, die Anfechtungsmöglichkeiten auszuweiten. Zugunsten der Gläubiger sollten im Rahmen der neuen Ordnungsfunktion des Insolvenzrechts vermehrt Ansprüche zur Masse gezogen werden, die von den Insolvenzverwaltern gerichtlich durchgesetzt werden müssen. Wegen unzulänglicher Massen sind die Insolvenzverwalter, wie auch bereits zu Zeiten der Konkursordnung, jedoch meist auf eine Fremdfinanzierung angewiesen: Entweder durch staatliche Prozesskostenhilfe oder mit Hilfe der Finanzierungsbereitschaft von Insolvenzgläubigern. Da beide Finanzierungsmöglichkeiten in der Praxis eher theoretischer Natur sind, blieb den Insolvenzverwaltern oftmals nur (...) noch die Möglichkeit, das Klageverfahren auf eigene Kosten und eigenes Risiko zu führen und damit in unzulässiger Weise privates Vermögen mit dem Insolvenzverfahren zu verbinden. Seit der Jahrtausendwende haben sich nun gewerbliche Prozessfinanzierer auf dem Markt etabliert und stellen für Insolvenzverwalter eine sinnvolle Finanzierungsalternative dar. Die vorliegende Arbeit befasst sich mit den Problemen, die sich im Zusammenspiel des Insolvenzverwalters mit der gewerblichen Prozessfinanzierung und der staatlichen Prozesskostenhilfe ergeben. Sie soll all denjenigen Verfahrensbeteiligten eine sinnvolle Hilfe sein, die in der täglichen Praxis mit den aufgezeigten Problemen konfrontiert werden. (shrink)

It provides a brief outline of the meaning of economism — as a term and a concept — and then explores the issues that are related to the measurement and monetary valuation of the items to be included in economic evaluations, otherwise known as the valuation problem. The article also deals with the commensurability problem and the intrinsic value problem. Im Jahr 2013 feiern die gelehrte und die politische Welt den 500. Jahrestag des Erscheinens von "Der Fürst ". Ohne Übertreibung kann man diese Schrift von Niccolò Machiavelli als einen der großen Schlüsseltexte in der Geschichte der politischen Philosophie bezeichnen. Nach dem schon geflügelten Ausdruck „Machiavellismus“ soll sich Machiavelli für eine Machtpolitik eingesetzt haben, die, von aller moralischen Verpflichtung losgelöst, ebenso rücksichts- wie skrupellos agiere. Machiavelli plädiert aber nicht für eine Entmoralisierung der Politik, vielmehr stellt er sich einer strukturellen Komplikation. (...) Sie beschwört einen Konflikt von zwei verschiedenen Moralen herauf, vom Staatswohl und von der für das persönliche Leben gültigen, der personalen Moral. Für diesen Konflikt schlägt er eine Prioritätsregel vor. Solange es nur möglich ist, bleibt es auch dem Herrscher verboten, vom Guten, zu verstehen als personale Moral, abzuweichen. Allein dort, wo die „menschliche“ Waffe nicht ausreicht, darf man auf die „Gewalt der Tiere“ zurückgreifen; nur wo die Macht der Gesetze nicht genügt, soll man die Kraft des Löwen mit der List des Fuchses verbinden. "Der Fürst" handelt von einem Herrscher, der unter realen, das heißt bei Machiavelli stets: schlechtesten Bedingungen, dennoch sein Amt relativ gut versieht. Diesen und vielen anderen Aspekten widmet sich der neue „Klassiker-Auslegen“-Band in zwölf detailreichen Analysen, die von international anerkannten Philosophen und Machiavelli-Forschern verfaßt wurden.
